Digital Shovel Takes Action Against RK Mission Critical for Patent Infringement

Digital Shovel Holdings Inc. sued RK Mission Critical LLC, RK Mechanical LLC, and RK Industries LLC in May in the U.S. District Court for the District of Colorado for patent infringement. “Instead of competing fairly,” the complaint states, “Defendants are exploiting the innovative technologies that Digital Shovel has worked to develop and protect through its patents.”

The dispute began in 2019 when Compute North approached Digital Shovel and asked to license Digital Shovel’s groundbreaking V-Shape technology, which allows for significantly higher miner densities in cryptocurrency mining containers. Digital Shovel declined the request, recognizing the unique value proposition of the innovation. RK Mission Critical began producing containers that were strikingly similar to Digital Shovel’s, and Digital Shovel employees mistook them for their own product, albeit with a different paint job.

Originally designed in 2018 and protected by three patents, 11,910,557, 11,647,605, and 11,540,414, granted in 2022, 2023, and 2024, the V-Shape technology provides significant operational and financial benefits to mining operations by increasing miner density by up to 30%. Knowing of the pending patents in early 2021, and even after the additional patents were granted, RK Mission Critical continued to produce containers using Digital Shovel’s technology without permission.

With RK Mission Critical refusing to engage in meaningful settlement negotiations, Digital Shovel has been forced to take legal action. Digital Shovel is seeking compensation for the misuse of its patented V-Shape technology and a court order prohibiting future sales of the infringing containers.

Digital Shovel alleges that RK Mission Critical illegally sold hundreds of containers using Digital Shovel’s patented V-Shape technology. This blatant disregard for intellectual property rights not only undermines Digital Shovel’s hard work and innovation, but also sets a dangerous precedent for the industry.

Digital Shovel is committed to protecting its intellectual property rights and will continue to use all legal means to hold RK Mission Critical accountable for its actions.
